MARRIAGE CONTRACTS IN LAW AND ALBANIAN SOCIETY AND THE POSITION OF THE SHARIA
The objective of this research paper is to study the various types of marriage contracts used in Albania because there are a number of marriage contracts being used that are not based on the Shari’ah. In fact, they clearly contravene the Shari’ah. This is due to the absence of Islamic laws in the area of family law, and marriage laws in particular, and due to the fact that manmade laws not based on the rulings of Shari’ah are being applied. This prompted the researcher to study this topic and clarify the related Shari’ah rulings followed by what he perceives as appropriate solutions from the Shari’ah that address the society’s needs and challenges. Some members of this society still restrict themselves to the Shari’ah in relation to marriage within their own local communities away from unjust laws that contravene the Shari’ah. This Islamic marriage contract entered into by some Albanians privately is not legally recognized. This paper concludes with a number of results and recommendations. Lastly, Allah knows all intentions and He is the One that guides to the Straight Path.
