ALMAFHUM ALEILMIU LILMUJTAHAD AL'USULII

ABSTRACT The Scientific Concept of mujtahid( the hard-working Fundamentalist). Praise be to Allah, the Lord of the Worlds, and prayers and peace be upon our prophet, and His family and companions. This research consists of an introduction, two papers, eight demands and a conclusion. The introduction contains the introduction of the topic to suit its problems. The first topic: the concept of Fundamental ijtihad, it individually presents the concept of Ijtihad among the people of the Arabic tongue, and the people of the assets, which is the subject of the first demand. As for the second topic: Rulings on ijtihad in Islam and the conditions, it also consists of four demands: The first demand is the ruling on ijtihad. It states that the scholars divided the ijtihad in general into two sections: Section I: Individual duty on everyone who reaches the responsible age and conditions to perform religious duties in Islam. Section 2: Collective duty, which is that there is in the nation who strives to find the appropriate Shari'ah ruling for the new issues, and that the Mujtahid cannot do so unless he has deep knowledge of the positions of the Islamic jurisprudence. The second demand :  It is about the evidence of the legitimacy of ijtihad: from the Qur'aan and Sunnah, and the consensus of the Sahaabah (may Allaah be pleased with them). In the third demand: I highlighted the conditions of Ijtihad, the majority of the fundamentalists, and Imam Shati’bi, in Almowafaqat. In the fourth demand: the virtue of Itjihad in Islam, its benefits, and its fruits; and that of its benefits; it also concluded many of the demands of the quality of the statement; to highlight the opinion of the researcher.

Conclusion : Ijtihad scholars and fundamentalists are the best and the highest people; because they are the heirs of the Prophet , peace be upon him,in the statement of the Legitimate evidence, and work it. It is not permissible for one to strive and to lead the fatwa (opinion concerning Islamic law) unless he is a scholar of the Arabic language and its arts in general, with the legal sciences of origin, jurisprudence, interpretation, and speaking In general, knowing the purposes of The legitimate purposes, so that he can realize the purpose of God Almighty, and his Messenge, peace be upon him. Ijtihad should not stop, until the branches are presented to their origins, and we know the reasons for their diligence, and it does not depart from the circle of the legal texts and the precise rules that were built and bound, and no one can invade it unless they possesses its keys and know its secrets And he walked with great patience and knowledge. May Allah bless our prophet and master Muhammad and his family and companions, and those who follow them to the Day of Judgment.
