This study aims to highlight the societal and legal position on the subject of the categories of women it is unlawful for a man to marry in Albania, since the legal and societal position does not comply with the provisions of the Shari'ah regarding this issue. The law, which stems from the societal perspective on this matter, expands the circle of unlawful categories by including those which it is halal (permissible) to marry in the Shari’ah, while on the other hand, it removes some categories of women from the circle of unlawful categories according to Shari’ah law.
To do this, the researchers will study this subject through a brief summary of the categories of women it is unlawful to marry according to the Shari’ah, accompanied by the societal and legal position on the unlawful categories. This will be followed by underlining the position of the Shari’ah regarding Albanian society’s culture and family law. Lastly, the researchers provide some recommendations and proposals through which an Albanian Muslim can apply the provisions of his religion, without falling into legal violations that may expose him to legal action and prosecution.
