SIAGH ALNAHII FI TARAJUM SUNAN ABN MAJIH DIRASAT 'USULIA


The researcher clarified the meaning and indication of proscription in the commentary of Ibn Majah in his book named Al-Sunan. As known by learners of Usul Alfiqh, the expression of proscription (nahi) is a general concept which can possibly mean prohibition or abhorrence. In the commentary of Sunan Ibn Majah, the word nahi came in a general sense where the researcher tackled the expressions of prohibition in a single section and he cited examples from the prophetic Traditions to indicate the prohibition of certain items. The prophetic Traditions which indicate the expressions of nahi which denote prohibition is the focus of the researcher’s study.

The second section involves the expression of nahi which indicates abhorrence. After studying the meaning of that word and supporting that with examples from the prophetic traditions. The researcher mentioned the opinions of the jursits regarding the studied issue whether it means prohibition or abhorrence. He confined his research to the well-known Four Fiqh Schools of Islamic Law. He cited their evidences for each opinion. From this, the reseacher decided the meaning of Nahi in the commentary of Ibn Majah on his books’ chapters.
