The judiciary is insuring the rights of individuals from any arbitrary; and the independence of the judiciary is the insurer of any interference or influence, but it lacks insurance to protect the judiciary, including insurance to install an investigating judge. This paper seeks to explore the relationship between the tenure of an investigating judge in Saudi law and his independence, and the independence of his installation. The importance of the paper lies in the assessment of these insurance, the extent of their agreement with Islamic law and international law. The researcher adopts the comparative descriptive analytical approach to collect data. The results of the study confirmed that the existence of some problems and gaps in the insurance of the independence of the investigation of the Saudi law relating to the installation of the judge, The researcher recommended some amendments to the legislation guaranteeing the installation of the investigating judge in the Saudi law.
