This study aims to study Imam Mohammed Anuar Al Kashmeery‘s weightings in terms of the sales in his book ( Al Uroof Al Shathi Shareh Sunan Al Termithi) and to know to what extend his weightings in his doctrine that he has brought up. The problem that this study attempts to address lays in that most scholars who rear in a certain doctrine of a particular jurist and they learn through this doctrine they will be affected by this doctrine and its traditions when they look to the legitimacy texts and work out some rules from those texts. One of those scholars is Imam Al Kashmeery, Allah mercy him – since he has brought up in Al Hanafi doctrine and learn all his teaches and instructions from this doctrine. He has many jurisprudential types of weightings through explaining Al Termthi’ sunan and to see to what extend he has influenced by this doctrine. The significance of the study lays in the explanation one of the causes of the differentiations between the scholars and their opinions varieties in terms of the legitimacy evidences and its interpretations and then to know the backwards of their views and judgments. The inductions approach is used in this study to trace Al Kashmeeery’s weightings to show its backwards ,the comparative approach is used to show what has been corresponded and differentiated with Al Hanafi’ doctrine. The study comes up with the following results: the researcher find ten sections in terms of sales in the book Al Uroof Al Shathi. Al Kashmeery May Allah mercy him , has corresponded with evidence when he made his weightings in six of these sections out of ten and the other four were influenced by his doctrine that is, Al Hanafi doctrine. Imam Al Kashmeery depended on Hadiths when he made his weightings. He relayed also on his scholars sayings when he made weightings. |
