ABSTRACT In the light of the tremendous development that the world has experienced in Information Technology field (IT), it becomes necessary to protect the electronic information particularly that featured with the confidentiality & privacy; Since some cybercrimes have surfaced up didn’t exist earlier, cybercrimes might consider as one of most dangerous crimes that put the international community in big challenge to limit the level of such crime at least, so enormous of international conventions has constructed to combat cybercrimes in general and cyber espionage particularly, this research paperaimed to shade the light on such danger cybercrimes in perspective of Sharia’ law and international law to highlight the aspect of defaults in in the law in so far. The paper will tackle the problem of to how extent the international law appropriate in combating this crime and the legal loopholes that the researcher suggests to close it to stop such cybercrimes. This reach paper is divided into five chapters; The first chapter discusses the perception of cyber espionage, while second chapter discusses the different between the cyber espionage and hacking, third chapter examines actus rues and men's rea elements of cyber espionage crime with elaborating in physical section, the modern means & tools of cyber espionage, as well as what is the significant fields that cyber criminals focus on it, whereas chapter four examines the combating of cyberespionage through applying Sharia’ law and the fifth chapter discusses combating of cyberespionage through applying international law, then conclusion and recommendations. This research paper will apply inductive, analysis and comparative approaches. |
