TREATMENT OF DHIMMI IN THE MALIKI MADHAB: A STUDY OF CHOSEN JURISPRUDENTIAL ISSUES

ABSTRACT

This study concerns chosen jurisprudential issues in the Maliki Madhab (school of Thought).  Such issues can provide information on how to treat or deal with a non-Muslim in the Maliki Madhab.  It is hoped to highlight tolerance and openness of  theMaliki towards a non-Muslim, as a feature from the moral and political features that propagated by the true Religion. The issue of communication with people of other religions considers an important sensitive old-new issue where prejudiced people alleged that Islam is disrespectful and negative. From here comes this research trying to evaluate this allegation through pointing out different issues in the Maliki Madhab.  Choosing this particular Madhab does not indicate that other Madhahib(Schools of Thought) do not tolerate non-Muslims. Rather the Maliki Madhab is chosen for narrowing the scope of the study and specialization and expansion (of the studied maters). Among the important issues that the researcher chose are giving charity, zakat and endowment to a non-Muslim, feeding him from the Sacrifice, and letting him breastfeeds Muslim-children. The researcher recommends conducting a similar study in other SunniMadhahib to highlight tolerance of Islam with Dhimmi (Non-Muslim under protection of Muslim law). This could in turn exhibit this Religion (Islam) in its real spotless practical picture. Additionally, this also considers as invitation and exhortation to Islam.
