JURISPRUDENTIAL IMITATION OF CHARITABLE EVENTS: A STUDY OF SELECTED EXAMPLES

Abstract:
This paper scrutinizes to what extent legal responsa, or nawazil, were issued in response to cases related to philanthropic work. Undoubtedly, these responsa reflect a certain legal craft that combined both theory and practice especially though ruling maxims and legal precedents. The preliminary question that remains in this present study though is how appropriately one can employ these legal responsa to wrestle with similar cases in contemporary philanthropic work. The paper will answer this question by defining the analogical prerequisites between these legal responsa and contemporary philanthropic activities in conjunction with legal reasoning, or ijtihad, ruling maxims, and the requirements to apply those responsa to contemporary philanthropic work. Such an attempt also contributes to the general discussion on how early and pre-modern legists and jurists engaged with the legal issues with respect to this particular area (philanthropy) at their times and how they contributed to the prevalence of philanthropic values among their own communities by and large.
