THE NECESSITY OF LIFE PRESERVATION AND IT’S IMPLICATION IN FAMILY LAW 1991”SUDAN”

Abstract This research aims to study the purposes of Islamic law, and focus on the purpose of self-preservation, by standing on its contemporary applications in the Sudanese personal status law, as we will be able through these applications to stand on the fact that the personal status law converges with Islamic law and its overlap with it, starting from the legitimate purposes of the five colleges. This focused vision is related to the importance of this research and the reasons for its study, which we summarize in the necessity of highlighting the importance of the purpose of self-preservation through the texts of the Sudanese Personal Status Law, and an explanation of how the Sudanese legal legislator takes into account the preservation of oneself through personal status laws, As a result of this importance calling for the study of this subject, a general problem was represented in the main question: What are the applications of the purpose of self-preservation in the Sudanese Personal Status Law? This question is implicitly related to the desired goal of this research, which is to clarify the purpose of self-preservation as one of the necessities of Islamic law and to show the adoption of the Personal Status Law in Sudan on Islamic Sharia and taking into account that purpose. It reached a set of results, the most important of which is that the Sudanese legislator was concerned with the goal of self-preservation through legal legislation that ensures the achievement of this goal.
