THE VERBAL SIGNIFICANCE BETWEEN ESTABLISHMENT AND AFFIRMATION AND ITS IMPACT ON THE JURISPRUDENTIAL CONTROVERSY

Abstract This study includes the founding of the alert on a new meaning derived from the repetition of the word or comment on a condition or adjective، corresponding to the emphasis on the alert on a meaning that is the same as the previous meaning understood from the repeated word or comment on a condition or adjective. The study is divided into an introduction، five sections and a conclusion. The introduction includes the significance of research، its objectives، a statement of the problem، the limits of the study، its methodology، and its plan. As for the introductory section: it defines the terminology of research، namely، significance، fluency، establishment، affirmation، jurisprudential controversy and idiomatic language. The first part includes literature review and previous studies of the meaning of foundation by pointing out the differences between it and the start and reception and construction، and then study the usefulness of a new meaning of a word. This is what is meant by establishing and its most important conditions and contraindications. The second part: studying the origin and confirming it through the differences between it and the consecutivity and simultaneity، and then sections of the confirmation and then the types of confirmation terms that respond to the words. The third part: It covers the general concept of establishment is more important than confirmation and the rules pertaining to its meaning، and its provisions. The fourth part: applications that show the impact of differences in the construction of the words on the establishment or confirmation from a source point of view، where some source applications illustrate the impact of this difference. They were represented by the dispute in the successive orders، and the order after the ban، and the elimination of a new order، the pending condition or Adjective، and the repetition of the conditional sentences before the reward is received. The fifth part presents the applications that illustrate the effect of difference in the construction of the word on the establishment or confirmation of jurisprudence، and the collection of some doctrinal applications، and the like in the dispute in the number of numbers when repeating the words of divorce، and the difference in calculating the number of atonement when repeating the words of truth. Another application is the calculation of financial disclosure in case of repetition. These applications rely on primary and secondary legal sources for the purpose of clarifying and simplifying the concept of the institution or confirmation.
